Hi guys. So today I have an issue than need helps. I have a friend who recently privately proposed to his boyfriend. He has been gay for more than 5 years. Well, he tells me he was born gay, haha. But the thing is that he is African. As you all know that Africa do not support the LGBTQ people. He is even facing hostility from family members because of this. He is now 33 years old. He would have married like 3 years ago but the family is not happy with him. He is from Nigeria and the rules there are strict. He is now thinking of going to marry his boyfriend in USA. Since it is legal there. But he wants me to help him with more information concerning this. Are there laws that govern gay foreigners in USA? What should they do to enable them have the wedding. Are there rules to follow? He is so stranded with what to do. Kindly answer my questions so that I might help a friend out.

There are a lot of ever-changing details to US immigration law and I find that a lot of well meaning people on the internet will often give bad advice. For instance, you mention your partner is from Australia. I happen to know that there are some immigration rules that are different for Australians than for citizens of any other country, due to a bilateral trade treaty. In this case, they happen to be especially favorable. But even somebody who is quite familiar with the process and has gone through it themselves, if they are not involved with it on a daily basis in a professional capacity, could easily miss such a detail. Also, while you probably just meant to say you don’t plan to have an elaborate wedding, you need to be careful writing things on the open internet like “not the big marriage”. You don’t want a literal-minded immigration official to google your name and find any evidence that your marriage could possibly be intended just for immigration.
